Terms of service

1. Object

These Terms of Service ("TOS") define the conditions under which ForgeNet makes available to users and customers the forgenet.solutions site and its software tools (Nexus / FHConnect, Atlas / FHPlanner, Nova / FHSim, Falcon / FHField, i9amati).

2. Acceptance

Use of the site implies full and unreserved acceptance of these TOS. ForgeNet reserves the right to modify these TOS at any time. Users are invited to consult them regularly.

3. Account creation

Access to certain features (demonstrations, quote requests, customer area) requires creating an account. The user agrees to provide accurate information and keep it up to date. The account is strictly personal. ForgeNet reserves the right to suspend any account in case of fraudulent, abusive use or violation of these TOS.

4. User obligations

• Use the services in accordance with their intended purpose and applicable law.
• Not attempt to circumvent security measures or access unauthorized features.
• Not use the site for illegal, fraudulent, defamatory purposes or in a way that infringes third-party rights.
• Keep login credentials confidential.

5. Intellectual property

All elements of the site and ForgeNet tools (source code, design, content, trademarks) are the exclusive property of ForgeNet or its rights holders. No implicit license is granted. Specific terms of use for each tool are set out in the commercial contract signed with the customer.

6. Service availability

ForgeNet implements reasonable technical means to ensure the availability of the site and tools. However, the service may be temporarily interrupted for maintenance, updates or reasons beyond our control (hosting provider failure, cyberattack, force majeure). No 24/7 availability guarantee is offered on the public site.

7. Liability

ForgeNet cannot be held liable for indirect damages, data loss, loss of profit or reputational damage arising from use of the site or tools. ForgeNet's total liability, for all claims combined, is capped at the amount paid by the customer during the twelve (12) months preceding the claim.

8. Personal data

Personal data processing is described in our privacy policy.

9. Termination

The user may at any time request deletion of their account by writing to [email protected]. ForgeNet reserves the right to terminate an account for serious breach of these TOS, after notification.

10. Applicable law and jurisdiction

These TOS are governed by Moroccan law. Any dispute relating to their interpretation or execution shall, failing amicable agreement, fall within the exclusive jurisdiction of the courts of Casablanca.
